2010 EC Response on TAMA 2009 Taxes and Closing of Bank accounts

Dear TAMA Member,
At the very outset, we would like to state that this will be the last e-mail communication from 2010 Executive Committee about the recent issues concerning filing of 2009 taxes and the closing of 2009 TAMA bank accounts. In order to provide truthful information, we have attached the relevant emails which made this communication a lengthy one.
“Why was the new EC kept silent for this long and now apparently decided to blame the 2009 EC for everything without giving us a chance to clarify the issues to the incoming EC.” – TAMA 2009 President and Treasurer.

We would like to point out that we have not kept quiet. We have also given enough time to the 2009 President and Treasurer to “clarify the issues to the 2010 EC”. We have been actively pursing this matter with the 2009 President and Treasurer. The only reason we have held this information back from the public was to maintain the dignity of the TAMA organization and a fair chance and benefit of doubt to the 2009 team.
The 2009 President and Treasurer have stated that we have never called or sent an e-mail to them. We have sent multiple e-mails and conversations regarding 2009 taxes. We have documentary evidence of these e-mails.

On Behalf of TAMA 2010 EC I sent below email on July 7, 2010. So far we haven't received any response from you. Tax returns for 2009 with penalty date expired on 15th of this month. We would like to know the status of TAMA tax returns for 2009. Could you provide the copy of tax returns or CPA info, If tax returns are filed. TAMA audit
Committee is waiting for this information to complete their job.

Mahesh sent an email and made a phone call to 2009 President and treasurer about 2009 tax returns.


With all these attempts’ TAMA 2010 EC never get any feedback from 2009 EC

Finally EC discussed about mediation which is initiated by TAMA first president Dr. Jagan Mohan Rao garu.

TAMA 2010 EC welcomed the proposal from Mr. Jagan Mohan Rao

The 2009 President and Treasurer have quoted Mahesh Pawar’s e-mail as evidence of communication; however they have conveniently concealed other related e-mails correspondence from Mahesh Pawar which shows that the facts are being buried.

Mahesh Pawar – 2010 Cultural Secretary made phone calls and sent e-mails on behalf of 2010 EC about 2009 tax returns.

We are appalled at the blatant denial of the 2009 President and Treasurer regarding this correspondence. The evidence will prove that TAMA members cannot be taken for a ride without substantial evidence.


“We are in the process of completing the Tax filing for the year 2009 and all the invoices, receipts and Bank statements are with the CPA who is providing free services to TAMA 2009. We shall submit the Returns statement once the filing is completed. This may take not more than a week. “

The deadline for filing Taxes as set by the IRS is March 15th for non profit organizations. Why didn’t the 2009 President and Treasurer file taxes till date? This puts TAMA’s non profit status in jeopardy. This shows negligence and lack of responsibility towards the community. By bringing past committees into the picture, they are only side stepping their lack of responsibility.


The checks are issued to individuals towards expenses reimbursement. As part of the account transfer procedure to the new EC, we closed the operating account on 31-DEC-2009. Any checks deposited after this date will obviously get bounced. It came to our notice that the only check issued to Mr.Ramakanth Rapalli towards election stationary expenses was bounced because the check was deposited by him after 31-DEC-2009. We referred this issue to the new committee and Mr. Rallapalli got paid by TAMA 2010 EC.

As a best practice of a community organization, accounts were not properly transferred to the 2010 EC and instead they were closed. The 2009 President and Treasurer have claimed that only “one” operating account was closed. This is untrue. Instead, multiple accounts were closed, including Suresh Penchala’s and Sudheer Rudraraju fund account, TAMA operating account and two Certificate of deposits. The CD’s were closed before their maturity date. This information was found out only by the 2010 EC directly from the bank. In their response, the 2009 President and treasurer did not mention any of the above information. Where they kept that money? Why has this information been kept under wraps and not properly conveyed to the respected TAMA members?

Note: We have closed CD account numbers and closing dates but security reasons not providing here.


Even though the accounts were closed, proper funds were not retained nor this information conveyed to the 2010 EC regarding outstanding checks.


In the process of accounts hand over to the new EC, the Credit Card operating account was closed on 31-DEC-2009 and a new account was opened by TAMA 2010 EC. We had a vendor called Authorize.net which we use it for our online transactions. The service charge was to the vendor was set up as a bill payer and all the instructions including the User ID and Password to the Credit card account was given to Mr. Aluwal Reddy Treasurer 2010. It was his (Or TAMA 2010 President's) responsibility to update the automatic bill payment to the vendor, failing which the vendor charges fines and even can send a collection notice to the person under whose name it was registered. In this case Mr. Adi Chinnatimmareddy was penalized.

This shows sheer negligence and non-commitment of the Treasurer of TAMA EC 2010, towards the fag end of the year they are conveniently blaming TAMA 2009 EC. Why did it take this long for them to bring it up? If anything of this sort was brought to our notice, we will be more than happy to address this.

Could you work with Mr. Adi to close previous on-line bank card processing account with North American Bancard. I think bank people are creating some problems, since you guys closed bank account with out redirecting that process. TAMA 2010 EC paid pending transaction fee to North American Bancard. They are holding some of TAMA funds. The related account was closed by previous committee. Could you work with Mr.Adi in order to get TAMA funds from North American Bancard. TAMA 2010 EC would like to present accounts in upcoming GBM on July 25th, 2010.

Things are going haywire the merchant account. I have received a letter (see attachment) from collection agency that TAMA did not pay monthly processing fee to North American Bancard Association. Not sure how to go about it to resolve this once for all. I have called the collection agency about the letter. They have said that the merchant account have not received monthly processing dues( Not sure what we did with the processing bank). This can jeopardize any things for the organization going forward, since they (collection agency) do have the TAMA TAX-id etc and can do undo damage. I have called in to North American Bancard association' s senior agent to resolve and closing the account couple of times already. These people are paid to not to help. He was adamant to speak to me and kept on pressing to speak to collection
agency rather than to them.

Please take this email as serious as possible and let us try to resolve this ASAP, since they have lot our info on their files and along with TAMA's money.

Adi Chinnatimmareddy was penalized purely because the 2009 President and Treasurer closed the corresponding Wachovia bank account and that information was not conveyed to the 2010 EC. 2010 President sent an e-mail 2009 President and Treasurer on this issue, to which they have never responded. This clearly shows the malice of the 2009 President and Treasurer towards the 2010 EC and TAMA.

Despite the consequences of the above mentioned actions of the 2009 President and Treasurer, 2010 President and Treasurer worked with North America Bank Card, Authorize.net and Adi Chinnatimmareddy to resolve the issue to everyone’s satisfaction incurring financial expenses.


Ramesh who is brother of Mr. Suresh Penchala repeatedly called TAMA EC 2010 requesting for the funds while TAMA EC 2010 turned a deaf ear to him.

TAMA 2009 EC closed Suresh Penchala account with out reason in December 2009 but they never disclosed this information to TAMA members. 2010 EC were only provided a check by the 2009 Treasurer for $59501.29. 2010 EC was not provided any documentary information regarding these transactions as claimed by the 2009 President and Treasurer in their response. Why are the invoices not being disclosed to TAMA members?

Ramesh Penchala did approach the 2010 EC and the 2010 EC requested Mr. Ramesh Penchala to provide documentation of expenses so that the 2010 EC can reimburse any expense with proper invoices as required by IRS and FERA. We finally received these invoice from Ramesh Penchala on October 20th and we are processing his request.


In order to book the Venue in advance we had to sign the contract with Center Stage and make a non-refundable advance of $5,000.00 and started making all the preparations for the event. Later due to the visa restrictions on the super singers, they were restricted to perform any stage shows (including at the TANA event) and subsequently we had to cancel the program. As the payment made to the Center Stage was nonrefundable in nature they refused to return the advance we paid. We tried to influence and convince them in various means and ways to get back the venue payment which turned out into a futile effort as they were all the time pointing to the signed contract with Center Stage.

Again,TAMA 2009 President and Treasurer are trying to escape from their responsibility. It is common knowledge that any facility provides an opportunity to recover significant percentage of the deposit if proper notice is given and due diligence is followed to recover the money.

All of this stems from the fact that TAMA’s 501(c) status is in jeopardy due to the actions of the 2009 President and Treasurer. It is already November and the taxes have not been filed. The deadline for taxes is March 15th. Why is it that the 2009 President and Treasurer have suddenly mentioned that they are filing taxes only when the issue was raised by the 2010 EC in a public forum? We had no other choice but to resort to this forum as the 2009 President and Treasurer have not properly responded to any of our multiple requests to facilitate this process. The 2010 EC is not against any individual person or group, it is only trying to safeguard the credibility and integrity of TAMA which has been built over 29 years of hard work of successive TAMA members and EC’s.

To be fair to the 2009 President and Treasurer, we would like to give them an opportunity to explain their side to TAMA members and/or a committee of mediators.
