2010 EC Response on TAMA 2009 Taxes and Closing of Bank accounts

Dear TAMA Member,
At the very outset, we would like to state that this will be the last e-mail communication from 2010 Executive Committee about the recent issues concerning filing of 2009 taxes and the closing of 2009 TAMA bank accounts. In order to provide truthful information, we have attached the relevant emails which made this communication a lengthy one.
“Why was the new EC kept silent for this long and now apparently decided to blame the 2009 EC for everything without giving us a chance to clarify the issues to the incoming EC.” – TAMA 2009 President and Treasurer.

We would like to point out that we have not kept quiet. We have also given enough time to the 2009 President and Treasurer to “clarify the issues to the 2010 EC”. We have been actively pursing this matter with the 2009 President and Treasurer. The only reason we have held this information back from the public was to maintain the dignity of the TAMA organization and a fair chance and benefit of doubt to the 2009 team.
The 2009 President and Treasurer have stated that we have never called or sent an e-mail to them. We have sent multiple e-mails and conversations regarding 2009 taxes. We have documentary evidence of these e-mails.

1) Madhu Tata - 2010 president sent multiple e-mails about 2009 tax returns to the 2009 President and Treasurer.

The 2009 President and Treasurer have quoted Mahesh Pawar’s e-mail as evidence of communication; however they have conveniently concealed other related e-mails correspondence from Mahesh Pawar which shows that the facts are being buried.

Mahesh Pawar – 2010 Cultural Secretary made phone calls and sent e-mails on behalf of 2010 EC about 2009 tax returns.

We are appalled at the blatant denial of the 2009 President and Treasurer regarding this correspondence. The evidence will prove that TAMA members cannot be taken for a ride without substantial evidence.

“We are in the process of completing the Tax filing for the year 2009 and all the invoices, receipts and Bank statements are with the CPA who is providing free services to TAMA 2009. We shall submit the Returns statement once the filing is completed. This may take not more than a week. “

The deadline for filing Taxes as set by the IRS is March 15th for non profit organizations. Why didn’t the 2009 President and Treasurer file taxes till date? This puts TAMA’s non profit status in jeopardy. This shows negligence and lack of responsibility towards the community. By bringing past committees into the picture, they are only side stepping their lack of responsibility.

The checks are issued to individuals towards expenses reimbursement. As part of the account transfer procedure to the new EC, we closed the operating account on 31-DEC-2009. Any checks deposited after this date will obviously get bounced. It came to our notice that the only check issued to Mr.Ramakanth Rapalli towards election stationary expenses was bounced because the check was deposited by him after 31-DEC-2009. We referred this issue to the new committee and Mr. Rallapalli got paid by TAMA 2010 EC.

As a best practice of a community organization, accounts were not properly transferred to the 2010 EC and instead they were closed. The 2009 President and Treasurer have claimed that only “one” operating account was closed. This is untrue. Instead, multiple accounts were closed, including Suresh Penchala’s and Sudheer Rudraraju fund account, TAMA operating account and two Certificate of deposits. The CD’s were closed before their maturity date. This information was found out only by the 2010 EC directly from the bank. In their response, the 2009 President and treasurer did not mention any of the above information. Where they kept that money? Why has this information been kept under wraps and not properly conveyed to the respected TAMA members?

Note: We have closed CD account numbers and closing dates but security reasons not providing here.

Even though the accounts were closed, proper funds were not retained nor this information conveyed to the 2010 EC regarding outstanding checks.

In the process of accounts hand over to the new EC, the Credit Card operating account was closed on 31-DEC-2009 and a new account was opened by TAMA 2010 EC. We had a vendor called Authorize.net which we use it for our online transactions. The service charge was to the vendor was set up as a bill payer and all the instructions including the User ID and Password to the Credit card account was given to Mr. Aluwal Reddy Treasurer 2010. It was his (Or TAMA 2010 President's) responsibility to update the automatic bill payment to the vendor, failing which the vendor charges fines and even can send a collection notice to the person under whose name it was registered. In this case Mr. Adi Chinnatimmareddy was penalized.

This shows sheer negligence and non-commitment of the Treasurer of TAMA EC 2010, towards the fag end of the year they are conveniently blaming TAMA 2009 EC. Why did it take this long for them to bring it up? If anything of this sort was brought to our notice, we will be more than happy to address this.

Could you work with Mr. Adi to close previous on-line bank card processing account with North American Bancard. I think bank people are creating some problems, since you guys closed bank account with out redirecting that process. TAMA 2010 EC paid pending transaction fee to North American Bancard. They are holding some of TAMA funds. The related account was closed by previous committee. Could you work with Mr.Adi in order to get TAMA funds from North American Bancard. TAMA 2010 EC would like to present accounts in upcoming GBM on July 25th, 2010.

Appreciate your response.

Madhu, Aluwal,

Things are going haywire the merchant account. I have received a letter (see attachment) from collection agency that TAMA did not pay monthly processing fee to North American Bancard Association. Not sure how to go about it to resolve this once for all. I have called the collection agency about the letter. They have said that the merchant account have not received monthly processing dues( Not sure what we did with the processing bank). This can jeopardize any things for the organization going forward, since they (collection agency) do have the TAMA TAX-id etc and can do undo damage. I have called in to North American Bancard association' s senior agent to resolve and closing the account couple of times already. These people are paid to not to help. He was adamant to speak to me and kept on pressing to speak to collection
agency rather than to them.

Please take this email as serious as possible and let us try to resolve this ASAP, since they have lot our info on their files and along with TAMA's money.

Any help from me, you can count on. Waiting for your response.

Thanks.

Adi.

Adi Chinnatimmareddy was penalized purely because the 2009 President and Treasurer closed the corresponding Wachovia bank account and that information was not conveyed to the 2010 EC. 2010 President sent an e-mail 2009 President and Treasurer on this issue, to which they have never responded. This clearly shows the malice of the 2009 President and Treasurer towards the 2010 EC and TAMA.

Despite the consequences of the above mentioned actions of the 2009 President and Treasurer, 2010 President and Treasurer worked with North America Bank Card, Authorize.net and Adi Chinnatimmareddy to resolve the issue to everyone’s satisfaction incurring financial expenses.

Ramesh who is brother of Mr. Suresh Penchala repeatedly called TAMA EC 2010 requesting for the funds while TAMA EC 2010 turned a deaf ear to him.

TAMA 2009 EC closed Suresh Penchala account with out reason in December 2009 but they never disclosed this information to TAMA members. 2010 EC were only provided a check by the 2009 Treasurer for $59501.29. 2010 EC was not provided any documentary information regarding these transactions as claimed by the 2009 President and Treasurer in their response. Why are the invoices not being disclosed to TAMA members?

Ramesh Penchala did approach the 2010 EC and the 2010 EC requested Mr. Ramesh Penchala to provide documentation of expenses so that the 2010 EC can reimburse any expense with proper invoices as required by IRS and FERA. We finally received these invoice from Ramesh Penchala on October 20th and we are processing his request.

In order to book the Venue in advance we had to sign the contract with Center Stage and make a non-refundable advance of $5,000.00 and started making all the preparations for the event. Later due to the visa restrictions on the super singers, they were restricted to perform any stage shows (including at the TANA event) and subsequently we had to cancel the program. As the payment made to the Center Stage was nonrefundable in nature they refused to return the advance we paid. We tried to influence and convince them in various means and ways to get back the venue payment which turned out into a futile effort as they were all the time pointing to the signed contract with Center Stage.

Again,TAMA 2009 President and Treasurer are trying to escape from their responsibility. It is common knowledge that any facility provides an opportunity to recover significant percentage of the deposit if proper notice is given and due diligence is followed to recover the money.

All of this stems from the fact that TAMA’s 501(c) status is in jeopardy due to the actions of the 2009 President and Treasurer. It is already November and the taxes have not been filed. The deadline for taxes is March 15th. Why is it that the 2009 President and Treasurer have suddenly mentioned that they are filing taxes only when the issue was raised by the 2010 EC in a public forum? We had no other choice but to resort to this forum as the 2009 President and Treasurer have not properly responded to any of our multiple requests to facilitate this process. The 2010 EC is not against any individual person or group, it is only trying to safeguard the credibility and integrity of TAMA which has been built over 29 years of hard work of successive TAMA members and EC’s.

To be fair to the 2009 President and Treasurer, we would like to give them an opportunity to explain their side to TAMA members and/or a committee of mediators.

Regards,
TAMA 2010 Executive Committee

Dear TSR & Girish,

This clearly proved that there is something you guys did wrong and trying to hide.

You guys will be draged to the courts if you don't show the accounting records to EC2010 immediately.

How could you misuse community funds.

SHAME ON YOU GUYS.

Dear 2009 EC,This clearly shows that you lied in your previous email to comminity that there was no communication to you all the year long and now all these emails and meeting mts prove that EC2010 has been begging you to provide the details but you didn't care and lied to the community.I am not sure how you can do this leave about the misuse of funds.First you should stop lying and also cannot get away by writing paragraphs in your email. So guys please apologise the community for your lies and we don't care if you form GATA or something else.

I don't think EC2009 has misused the funds.I know Satyanarayana reddy by close front and personally he is good and has values but I guess there is arrogance factor in him and association with Girish is the cause for the situation he is in right now.Any ways lying to the community that they were never contacted is un acceptable and I am not sure how they beleive that they can get away by blaberring something in the email. They should be very carefull when they address the community and they can't take the community for a ride.Satyanarayana reddy lost all his credibility and this will devoid of all his work and good things he did during his tenure.I pity him and i beleive that he is wrongly guided and to reiterate he is not a bad guy personally.

Don't u think EC 2010 has nothing to do.We have to accept the fact that they worked hard to keep up to the expectations and infact they beat the expectations and you guys by foul crying and tried to play the blame game and started GATA and with 42 participants inaugarated and with this present scandal i guess community knows what you are and will be left with no one with you guys.

Dear TAMA members,

The center stage issue was raised in Rachabanda long time ago on December 10, 2009. Check the following link.

http://tamarachabanda.blogspot.com/2009/12/center-stage.html

EC2010 did not bother to look into it at that time.

Obviously EC2009 did not bother to explain TAMA members what happened at that time.

At that time TAMAwala made the following comments in Rachabanda.

<<-- AS far as I know this is an expense towards bringing "Super Singers" to Atlanta. MAA TV crew with Mano participated in TANA July 4th 2009 celebrations and accepted to perform in various US cities after TAMA event. TAMA EC decided to host the troop in pursue of raising funds for TAMA so reserved Center Stage.

Unfortunately the Archestra crew didn't get VISA's and child artists got restricted VISA i.e.they can not perform outside of Chicago. This has caused Mano to cancel all the booked events outside of TANA.

TAMA EC tried to transfer the Center Stage reservation during a recent private event (Singer Sunitha show) but it is heard that Center Stage management declined the transfer forcing TAMA to forfeit the deposit.

There are couple of People outside of EC involved in this deal

TAMA EC 2009 should have explained this disputed expense before concenrs raised in members mind. -->>

There are couple of People outside of EC involved in this deal

Who are they. TSR already claimed that Purna was involved. So who are the other persons involved in this???

I am sure Bala must have involved in the Center Stage deal. APNA and TANA has links.

I am a bit surprised with the kind of lies TSR & Girish put forward in thier mail. Lying is one thing. Putting the lies in writing is a different ball game.

Would they spend the money the same questionable way in GATA!!. TAMA's money is communities money. GATA money is from their pockets. From their own pockets. Their own personal money. I am sure they will spend it with their life.

Just remember..

A lie may take care of the present, but it has no future.

Give it a thought.

Any significance!!. May be Gorre doesn't want his name to be associated with this Kula Sangham, like the rest of the community.

Mahesh Pawar

Pawar is in current EC, has he not explained to the peers what happened?
It is just a bad deal but not a fraud.

There are rumors that EC 2010 misused the funds from matured CD's. They should explain to the members what is the status of those funds.

Anonymous said...

Satyanareddy sent another email reiterating the lies again. They said initially in the first email that they never got any email from 2010 EC and came to know through Tama email only but in the latest email they said that they got mahesh email only which they did not mention in the 1st email and also presented only half of the email. Now they are saying that with Technology any thing can happen. There is a talk that current EC 2010 got the phone logs when they made the calls to satyanarareddy and girish and are ready to display to the public if needed.Every common man who follows the two email chain knows that 2009 EC is lying and they cannot manipulated the facts.Any ways it is waste of time to discuss this but 20p9 EC has to know that whole community knows that they are lying. But I don't think they misused the funds,They are not that bad people but definitely lied regarding the emails.

PART 1
False Allegations by EC TAMA 2010 on TAMA 2009 Financials
November 05, 2010

Dear Beloved TAMA member

Here is clarification to the second email sent by TAMA EC 2010. This will be our last email because we gave all the information that we had and we don't want to waste your time and our time on these baseless allegations made by TAMA EC 2010.

We once again want to confirm that we haven't received any emails. With the improved technology anything is possible these days. If a person did NOT receive your email then you try to call him/her. We did respond to Mahesh Pawar email by phone and NEVER received any calls from the President as he claimed. Anybody can check our call logs since December 2009.
Only Operating accounts are closed as per the norms (checking and Suresh Penchala). We all know well that once CD's are matured either you draw the money or continue the CD's. Therefore, we never closed any CD's before the maturity. We presented this information in the GBM twice (one on Diwali function and one on Election Day) and also kept on our website including the CD account numbers and the money. One should use minimum common sense in looking at the things. The dollar amount is NOT changed. The CD's are there. The Bank must have merged matured CD's into one account. This information was passed on to the treasurer.
We explained about all accounts to the treasures EC2010 on the same day. How come now TAMA EC 2010 rising questions after 10 months. We suspect some kind of conspiracy by TAMA EC 2010.
Is TAMA EC 2010 is trying to confuse its members by imposing all unnecessary allegations and cover up something regarding the CD funds.
We demand to publish the current status of CDs because most of those CDs could have matured by this time.
We are presenting the CD numbers and the money in it as of December 31st 2009. The following table clearly shows the funds we received from TAMA EC 2008 and the funds we transferred to TAMA EC 2010. CD Details Please check emails.

Part 2
Authorize.net issue is their sheer negligence. They need to fill a form and need to sign by the current President and past President. We clearly explained all the accounts information to Treasurer twice, once in the beginning and once in March by Girish in their conference call as mentioned in their email. Since he resigned right after that there is a communication gap for them. If you do NOT do your job diligently, then why are you blaming us?
TAMA Taxes filing is done all these years even though it is late, IRS will check whether it is proper or NOT. As per our knowledge 2006, 2007 and 2008 we filed the taxes late due to various reasons as each member has their personal life as well and we did NOT lose our identity, integrity or 501 3 C status.
Taxes are filed and any member who ever is interested, please let us know and we will show the information that you are looking for.
Current secretary, Vice President and Jaganmohan Rao made an attempt to sit with us and resolve these issues. However, the current President showed interest initially and backed off, please see his email. Instead he chose to go public without answering him and insulted a person like Jaganmohan Rao garu. He is just wasting your and our time by this.

Dear Telugu community,
This clearly denotes lack of experience on their part. Once you have rift these things go on and on. However, we would like to mention clearly that it is a blame game and waste of time for a cultural organization like this. This is our Last email as well to the community.

//It is just a bad deal but not a fraud.//

I agree that it is not fraud.

But it was totally inappropriate, rougish spending on their part for $5,000.00. They broke/ignored lot of procedures/protocols they should have followed, when they tried to spend the money. They didn't have the authority to spend it on thier will & wish. Period.

I wouldn't lighten the issue, by calling it "Just a bad deal".

TSR & Girish are little arrogant but individually they are lot better than any other local leaders, one thing for sure I can say is they don't have Jealous, but they are poor planners.

They need some one to plan and foresee things for them.

Naanna.... Pandhule gumpu ga vasthai simham single ga vasthundhi.... Go TSR & Girish....

You guys worked hard and did a great job during your tenure. You did what was right on the day, with good intentions. Everyone understands the current situation.

If they are so concerned about the "INTEGRITY" of Telugu community they would have resolved this amicably, instead of gathering proofs and witnesses to make a case against their own.

EC 2010 gave Mahesh Pawar General Secretary to shut is butt & mouth on this issue

Pawar is K's gulam from the begining,if not he wouldn't have won last year.
TSR&gang should have avoided him in first place.

Stop wasting time and money of the community

Why dont Election Committee do something like below...
Collect money from the Candidates who stood up for the Election...
1. Board of Directors (2 Years) - $2000.00
2. Board of Directors (1 Years) - $1000.00
3. Executive Committee (Top 4 Position) - $1000.00
4. Executive Committee (Rest of the Position) - $500.00

Come up with some kind of electronic format of election.

{{Why not call or email Guruva Reddy from your own identity and ask for his contributions? If you don't have the courage to do the above, why not at least list your own contributions here? Why should he answer your stupid questions if you can't even state your real name? Any idea boss?}}

There is no reason for Gurava to be shy & keep his contribution for the community to be secretive.

When ever he can muster some "courage", he can answer the stupid questions about his contributions so far. He can simply respond here with out being coy & every one can understand what a great asset he has been sofar.

After all he is the one who started talking about community & service. The onus is on him to list his contributions & prove his track record.

Get the idea boss!!

AP politics close ga follow ayye vaallandaru "tama"election theeta TAMA lo teerchukundamani chustunnaru, anduke every year elections ante intha hangama. ikkada panikimaalina panulanni chesi edo trupti paduthuntaru.
Lavu, Madhu, Mallik, Narendra started this with TANA membership in 2008.
They took this tradition to TAMA and made big mess in 2008 elections.
Shame on those who took TANA & TAMA memberships for Walmart gift cards. You not only sold your self but the community as well.
